Happy Birthday, Israel!

Jeremy Ben-David

On the occasion of the Declaration of Independence in which David Ben-Gurion announced the establishment of the State of Israel seventy seven years ago, I have allowed myself the luxury of celebrating Israeli innovation, rather than IP specifically, per se. Surrounded by an ever-expanding sea of inventive technologies from food to medicine to defense, communications and yes, water, I have chosen to tell the story of Simcha Blass and his invention of drip irrigation back in 1959. His story of discovery has not only changed agriculture in water-scarce parts of the world, but has inspired generations of innovators and their inventions that have brought good to the world in virtually every imaginable field.

It’s well known that the more attractive an invention, the more others will want to copy it. In fact, this goes for products of all shapes and sizes, and as businesses seek to protect their innovations and their products, IP of all kinds comes into play. Once you start to think about products and marketing, you start thinking “brands”, trademarks and domain names. And then you find that Ivan Lipshitz has just the information that you need, with his three part series on trademark audits, of which the present, third part, is a deep dive into such audits.

Continuing the theme of water, is Noam Shani who spoke to Avraham Hermon in our monthly podcast, about the life saving, inflatable flotation device developed by Neomare, of which Noam is one of the founders.

One final word about birthdays. A birthday is a time for celebration, but at the same time, it’s a time to take stock; to look back on our path thus far, and to try and look over the horizon, towards a better future, and a better world.

On a personal note, and without belittling the immensity of the difficulties that we have faced, and tomorrow’s challenges notwithstanding, I’m looking forward to a brighter future. Happy Birthday, Israel!

A Drop in the Bucket
Israel at 77 Years Young

by Jeremy Ben-David

“Necessity is the mother of invention” goes the saying. 77 years ago, the tiny population of Israel had to be resourceful in order to not only survive, but so as to build a future for itself. Located in a semi-arid area of the world, where the fertile soil is always thirsty for seasonal rains, where the winter lasts from November to March, and hot desert weather systems and cold, wet northerly systems do battle for supremacy, the availability of a reliable and plentiful water supply was always going be one of Israel’s major challenges. As long ago as 1959, a man by the name of Simcha Blass, noticed a tree on Kibbutz Hatzerim in the Negev Desert, that was thriving despite the arid conditions.

Blass's invention revolutionized agriculture by significantly improving water efficiency and crop yields, making it possible to cultivate crops in arid regions and conserve precious water resources.

The invention of Simcha Blass has become, over the years, but a single story out of thousands. When Blass observed that tree, managing to survive against all the odds in the arid desert, he couldn’t have known that both the tree and its supply of life-giving water would become a metaphor for the State of Israel through the years.

The letters that make up the number 77 in Hebrew also form a word “oz” which means strength. Despite the challenges, Israel has become a hub of innovation which benefits humanity in its entirety. The spread of drip irrigation throughout the world is both literally and figuratively, a mere drop in the bucket of humanity-improving innovation coming from Israel.

This is the message to the people of Israel as we celebrate our birthday, even as we go through challenging times; and this is the message from the people of Israel to the world!

by Ivan Lipshitz, Adv., JMB Davis Ben-David

In this article, I detail how an “In -Depth IP Audit Review” should be undertaken. This will  give you a more detailed, nuanced and in-depth review of your trademark rights and domain names. It will assist in the evaluation of the “health” of your trademark and domain name portfolio at any given point in time and the mitigation of risk and loss of rights. It will also help you to address possible opportunities and challenges, and to point you in the right direction for your long-term IP strategic planning.
