There’s Nothing New About Innovation!

Jeremy Ben-David

Innovation comes in all shapes and sizes and indeed, in different spheres of activity. In this spring month of April, corresponding to the lunar month of Nisan here in Israel, freedom was invented approximately 3,338 years ago – in 1,313 BCE. It is the anniversary of the Exodus that kicks off our weeklong holiday of Passover. Note that the Israel Patent Office will be closed during that time.

Since then, there has been non-stop innovation, in many varied fields, three of which form the subjects of this month’s newsletter. First, and in keeping a trend that seems to be in its early stages, the Israel Patent Office has recently launched a program for accelerated examination for applications in which at least 50% of the inventors are women. This is detailed below by our Mrs. Miriam Samis, an Israel Patent Attorney and US Patent Agent in our life sciences department, and it applies to applications regardless of origin.

A much less welcome form of innovation is the way in which the USPTO has decided to introduce some new fees. One of them appears to be similar to ‘congestion pricing’, but is effectively a tax levied on applicants who comply with legal requirements too rigorously. Curious? Read Dr. Mike Hammer’s article below.

Finally, in our monthly podcast, Avraham Hermon meets Ilay Marom, the Co-founder and COO of Nanose Medical. Ilay holds an MBA from the Kellogg School of Management at Northwestern University, and recently met with Avraham to discuss Nanose Medical’s diagnosis for diseases (fatty liver and lung cancer) through a breath analysis test that can be done in a primary care giver's office.

By way of a postscript, if you plan to attend the INTA meeting in San Diego and would be interested in meeting with any of our team in attendance, please contact us at JMBmail@JMBDavis.com.

Track “50 Plus One”IPO Launches
Expedited Examination for Women Inventors

by Miriam Samis, Israel Patent Attorney and US Patent Agent

Entitled “50 Plus One”, the Israel Patent Authority (IPA) has launched a new, expedited examination track aimed at supporting women inventors. Under this initiative, patent applications in which at least 50% of the inventors are women will receive a first Office Action within three months of meeting formal requirements.

The program is open to all applicants worldwide and guarantees quick examination for qualifying applications. Please either click here for more details, or email me directly at miriam.samis@jmbdavis.com or at our general mailbox: jmbmail@jmbdavis.com.

USPTO 2025 Fee Schedule Update
What’s Old is not New, it’s Merely More Expensive

by Dr. Mike Hammer, Senior Partner

In January, the USPTO revised its tariff of official fees; implementing an across-the-board price hike on the entire process of applying for, obtaining, and maintaining a patent in the US.  In an era of rising costs on everything from eggs to electricity, this may not be surprising.  What is surprising is that among expected increases in application and patent fees are two entirely new fee categories which may catch Applicants, and their local counsel, off guard. The first relates to surcharges on certain continuing applications. The second, is a relatively modest, yet bizarre penalty for providing the USPTO too much(!) disclosure during the application process.

Ilay Marom, the Co-founder and COO of Nanose Medical, an Israeli bio-tech startup that has made  a portable device that detects diseases without invasive procedures. Their electronic 'nose' quickly analyzes breath samples, identifying specific chemical compounds exhaled by patients. Through a combination of advanced nanotechnology and artificial intelligence, the system offers rapid disease detection in a single breath.

Avraham sat down with Ilay in the offices of Nanose Medical to discuss how they came up with the idea, how they got funded, how they deal with a startup during wartime, building a team, tips for startup founders and much more.
