Mañana
As anyone either located in Israel, or simply having business contacts here, will know, the month of October has been very busy â with holidays(!) All told, of the 23 business days in October, only 14 of them were not taken up by holidays or holiday eves. In Israel, there is an expression in Hebrew which , when translated literally, means âafter the holidaysâ. Itâs a rationale for procrastination of all kinds, inferring that the holidays are coming up, so afterwards. It is reminiscent of the Spanish word âmañanaâ. While I understand that it simply means âtomorrowâ, I was told quite some time ago that it is not used to mean âtomorrowâ, but âjust not todayâ. I suspect that a similar expression exists in many cultures.
Regardless, here we are. We are now both âafter the holidaysâ and mañana, and much is happening as we accelerate towards the end of 2024.
November is the usual timing for the IPBC Asia conference which, this year, is taking place in Tokyo. Having attended on a number of occasions, I have found that the draw for me is the relatively small size of the conference, with roughly 1,000 attendees, of whom about half are in-house counsel, many of them from corporations in China and Japan. It provides a unique opportunity to hear from the client side of the table â listening is a good idea at most times, and that is certainly the case at this event! I will be in Tokyo for the event together with my partner Dr. Mike Hammer, so if you plan on attending, drop me a line and letâs see if we can chat over a cup of coffee.
On a totally different front, we are pleased to extend a warm welcome to Ms. Shir Tsviat Suissa. Shir is an Israeli trademark attorney with experience advising clients on brand protection strategies and managing trademark portfolios. She also has experience representing clients in complex litigation and insolvency matters. Shir is a welcome addition to our team, and will be based in our Modiin Office.
Our newsletter this month sees Eviatar making a foray into the complexities of ownership of digital media, while Ivan dives into trademarks 101, getting back to some of the basics. Finally, our podcast has Avraham sitting down with Ben Wiener, founder of Jumpspeed ventures, a VC firm focused on Jerusalem innovation. Specifically, Jumpspeed is the first and only venture capital fund dedicated to investing in early-stage startups that originate within the resurgent Jerusalem startup ecosystem, and addresses the mismatch of supply and demand for early-stage capital in the Capital of the Startup Nation. In the discussion, Ben explains what lies behind what is in itself, a unique venture.

A company's name and its intellectual capital and technical know â how are among its most valuable assets and provide its greatest competitive advantage. They are the principal drivers of their success and shareholder value. When we talk about a companyâs or enterprise`s business or trade name, we are essentially talking about your company's face to its customers, investors, and the rest of the world, namely, its brand. Brand recognition and brand association are the cornerstones of your commercial success, and these are achieved through trademark registration and trademark protection.
Trademarks are highly valuable assets. According to one recent estimate, a trademark can be worth US $22.5 million for the median trademark, meaning in statistical terms the mid â value of a trademark value in a given dataset. In 2024, APPLE overtook AMAZON's position as the most valuable brand in the world. The technology giant had an estimated brand value of about US $ 516.6 billion U.S. dollars, while Amazon had onlyâŠ

As the world becomes increasingly digital, most of the digital media such as movies and video games are purchased through digital platforms, whether by purchasing a perpetual license (AmazonÂź, BandcampÂź, SteamÂź) or with a subscription through a streaming platform (NetflixÂź, SpotifyÂź).
From a young age, I have enjoyed video games. I still enjoy watching the occasional gameplay, following developments in the gaming industry and seeing what new games are being released. A recent article in IGN piqued my interest regarding user rights and prompted me to explore how different jurisdictions are addressing this issue.
In September 2024, the State of California passed The Consumer Protection: False Advertising: Digital Goods Act.
In contrast, the Court of Justice of the European Union (âCJEUâ) has ruled that it is legal for someone to sell previously owned digital goods.
