A Review of 2021

 

In this current, first edition of 2022, we take a look back at 2021 and some of the articles that various members of our firm felt were worthwhile sharing with our readership. This is in addition to our monthly podcast which we hope you will find as interesting as ever!

In his practical, hands-on approach back in February 2021, involving one of his favorite areas of science, Avraham Hermon shared A Patent Attorney’s Lessons Learned from the Largest Cannabis Patent Litigation to Date.

This was followed by two articles discussing different aspects of enablement under US Law: Eviatar Aron’s May 2021 article Enabling Obviousness – Lessons from Raytheon Versus General Electric being followed the next month by Prophetic Limitations – Can there be Enablement Without Data? By Miriam Samis.

In a sudden change of subject in August, we were treated to a quick lesson in Rapid Patenting in Israel by Avraham Hermon, in which he asks and answers “What’s the magic and how can it help you with your patent strategy in other jurisdictions?”.

Finally, in a more self-reflective discussion, Jeremy Ben-David discusses Patent Attorneys – First and Foremost Members of Humanity as a way of connecting the IP profession and the World which we purport to help vicariously, arguing that we can and should – do more.

Asher Polani is a veteran entrepreneur in the Israeli start up scene. Having been involved in founding and growing multiple startups going back to the 1980s, Asher was CEO of FTS & Finjan and has filled various executive roles in HP-Israel, MINT Technologies and in other international companies.

Avraham sat down with Asher to discuss some of his latest startup successes, how to pivot a business that’s not working, raising money, bootstrapping, exits and tips for startup founders.

Mike Hammer kicked off 2021 with a proposal, namely, When Function is in the Form: A Proposal for Functional Designs.

If that was a suggestion for future change, we revisited actual change in the summer, courtesy of Eviatar Aron, when we referred back to his original announcement about The New Israel Design Law. Note the date August 7, 2023, as this is the earliest date when design applications filed under the new 2017 Israel Designs Law will be coming up for renewal. 

Finally, only a couple of months ago, Jeremy Ben-David discussed The Pros & Cons of Multiple Embodiments in an Israel Design Application. In case you’re curious about the bottom line, as (almost) always, it’s “ask; this is not a ‘one size fits all’ situation”.

This part of our newsletter is where we give vent to points of view, allowing observations and commentary, and sometimes some crystal ball gazing.

Jeremy Ben-David sounded off about Putting the Driver back into Driver Assisted Systems in April, and six months later sought to whimsically connect Termites, the Queen’s Speech and Patented Inventions in one fell swoop of his keyboard. 

Last, but by no means least, our newly installed managing attorney of designs and trademarks Ivan Lipshitz, treated the unacquainted to a skillfully written and comprehensive introduction to NFT`s and Their Interplay with IP.
